The effects of overturning Roe vs. Wade have been different for each state. The Supreme Court’s new ruling declared it is the responsibility of the states to determine when and how abortions are performed.Â
Some states have banned abortions except in cases where the mother’s life is in danger, while other states have reinforced a woman’s right to elective abortions.Â
So how has Georgia been affected in the wake of removing Roe? Here’s everything you need to know.Â
Can Georgia Residents Still Get An Abortion?
In March of 2019, Georgia lawmakers passed House Bill 481 which banned elective abortions after 6 weeks gestation, when a fetal heartbeat can be detected. This bill was originally ruled unconstitutional in 2020 but that ruling was reversed after the Supreme Court overturned Roe vs. Wade. In July 2022, the Heartbeat bill went into effect in GA which bans elective abortions after 6 weeks gestation. Before 6 weeks a woman is still able to get an abortion in Georgia. Â
This 6 week ban on elective abortions has faced some harsh criticism from other states. Let’s take a minute to understand the facts.Â
Special Circumstances
The Heartbeat law allows for abortion after 6 weeks gestation and/or when the fetal heartbeat is detected if her pregnancy falls under one of these categories: the life-threatening situation for the mother, fetal diagnosis not compatible with life, as well as reported rape, or incest. In cases of reported rape or incest, abortion is allowed for up to 20 weeks.
Ectopic Pregnancies
An ectopic pregnancy creates a life-threatening situation for the expectant mom. This kind of pregnancy occurs when a fertilized egg implants and begins to grow outside of the uterus.Â
If undetected by an ultrasound, the pregnancy will spontaneously rupture and cause severe internal bleeding. If a woman discovers she has an ectopic pregnancy after 6 weeks along, she will be able to have her pregnancy removed, no questions asked.Â
